On the behalf of the environment and natural resource manager, taking this opportunity to invite the prequalified tenderers to submit their tender documents for the mining work scheduled. All interested tenders must ensure that they are accredited by the government of Australia of mining accreditation scheme.

The department of environment and natural resource gives the assets as well as the advice regarding the facilitation of the interface of the state and the mining industry to the government of Australia. AS 4120-1994 1.2 P.2

This project is believed in the name of high ardency that is minister of environment and human resource which wishes to work in cooperation with the high agency, the miner manager and the appointed tenders in order to achieve the project objective within the required time within the provided budget, program and quality.

 Interpretation.

That the terms and the conditions of the contract shall be interpreted in accordance with the Australian tendering dictionary unless interpreted otherwise.

1.0. The period in which the tender is valid

The warranty of the tender shall remain for a period not less than 20 days from the date which the tender was submitted. In case the principle requests for the extension of this day, written letter should be forwarded to the tenderer.

2. Logement

3.1 The original tender must be placed in the enveloped marked clearly and sealed with the title of the tender, the time the tender closes and the name of the tenderer then submitted to the tender box or posted to the tender box to be received by the mining industry.

3.2 The tender may be lodged to the contact office using email or facsimile of the office to the address provided above. Similar to AS 4120- 1994 2.6 p. 4

3.3. the tender which is submitted via email or facsimile before the time of the closure will only be considered if the identical tender, that is complying with the Australian regulations is dispatched on the same day likewise delivered to the tender box by person, via email in between two business days after the time for the closing of the tender.

3.4 Any oral tender will and shall not be considered.

3.5. Any tender lodged in an incorrect location will not be accepted.

4.1 Not Authorised Communication.

All tenderers must communicate all information concerning the tender to the officer in charge unless it is directed otherwise by the contract officer. An authorised communication with staffs or other officer concerning this tender will lead to automatic disqualification.

6. Timetable Or The Procure Of The Tender Process

The industry intended timetable is as follows.

The date of issuing the tender.    Monday 10 June 2018

The date of closing the tender 2.00pm Friday 7 July 2018

The date of conclusion of the tender evaluation 6 August 208

The finalization and signing of the contract.   15 August 2018

The finalization of the submission of the final report 10 October 2018

7. Project Change.

 The mining industry in its power may revise this document or even provide additional information at any appointed time using a written notice.

a. before the closing date. All the people who have received the tender guide after the date of the closure will not be included in the tender process unless the industry in agreement resolve to accept the tender document. Conforms to  AS 4120-1994 section 6.2 p.32

b. And will not compromise the integrity of the whole tendering activity or give any un fare treatment to some of the tenderers. And

c. after the date and the closing time of the tinderbox, to all the tenders who have lodged.

8.1 Late Tenders

In compliance to the sub clause 3.2 above, which says tenders submitted after the closing time shall not be accepted in the tendering process  unless the industry in discussion and agree  that accepting such late tenders will not compromise the integrity of the tendering process or give favourable advantage to some individuals.

8.2 the tenders that were received late and not accepted will be marked on the envelopes, the time and the date in which they were submitted and they are returned unopened to the tender.

8.3. The industry may at the same time request the tenderers to provide the evidence which may assists in making the decision of whether to accept the tender or reject it.

9. Illegality

9.1 The tenderer must include any changes in the made to the tender

9.2 any tender containing the changes that are not included, or eligible information may be left out during the consideration.

Project Change

9.3 The tenderer should quickly inform the tender officer in writing if it is believed that there is an error ambiguity or omission in the tender.

10. Suspension

The industry may avoid to continue with or suspend the whole process or any other stage stated in the act or any discussion being conducted at that time with any tenderer.

11. The Rejection Of The Tender.

 The industry may automatically reject the tender that is not complying with the rules and requirements.

12. Conflict Of Interests.

12.2All tenderers must avoid putting themselves in apposition which may lead to arise in the conflict of intrusts between the tenderer and the industry during the tender activity.

12.2 If by any case any potential conflict of interest arises between the industry and the tenderer, during this time of the tendering process, the tenderer must them immediately notify the industry in waiting.

12.3 In the case of a potential conflict of interest arising, the industry may. Resolve the potential conflict with the tenderer.

a. the industry can reject the tender lodged from such attender or

b. the University can take any other action that they consider appropriate.

12.4 The industry has the right to either include alternative tenders on their advantage or not to complies consider then.

13. CONTENT AND THE FORMAT OF THE TENDER.

13.1 The tender must include all the relevant information that are requested by the industry unless it is directly specified.

13.2 All the items and features specified in the in the document are the most minimum information required by the industry unless directly specified.

13.3 The tenderer must also provide the tender under the tender cover sheet. The cover sheet is supposed to be complete filled in, likewise supported by any other relevant document that is necessary to make the tender complete. Clause AS 4120-1994 section 7.8 p.36 therefore the tenderer can provide the cover sheet in an elongated format to allow additional space for the response.

13.4. In the case where the tenderer wants to utilise the subcontractor, the all the information needed in the contract must be given in full for each of the subcontractor.

14. Price.

That all the compulsory are to be expressed in the Australian dollar

The tender must name all the prices without any additions.

Delivery strategies and techniques 30%

Tenderers augmented project collaborators and resources 30%

Late Tenders

The price for the tender will be adjusted considering the plan of the industry or the economic nature.

15. Tender Evaluation

The tender evaluation will be undertaken in order to determine is the best tender that represents the best value of money to the industry. Therefore in deterring the best price for the tender, the following criteria will be used.

15.1 Criteria for compliance.

That is in terms of compliance with the terms and the conditions of the tender

If the contract or the tender includes the insurance requirements and finally

The requirements of the industry in general.

15.2 Qualitative criteria.

This includes the possibility of the tenderer to fulfil the overall requirements of the university including the complex and management competencies, the financial situation of the tenderer, the professional skills, the experience and the general availability of the personnel similar to AS 4120-20994 2.4 p.6

The extent to which the price quoted adds value to the fees supposed to be raised and 

The extent to which the tenderer services meet the requirements of the industry.

16. The Formation Of The Contract.

The successful tenderer is required to put the signature on the contract supported by the extra information, requirements or even variations which are

b. that may arise during the evaluation of the tender and finally,

c. that is arising from the discussion and the negotiation activity.

There should be no contractual relationship and any other obligations which should arise between the industry and the successful tenderer for the period which the whole project is expected to take place and this clause are applying despite oral or documented advice to the tenderer leaking the information that the tender will be successful or will be considered.

17 The Applicable Laws

The law which is applying to the Australian still applies also in this tender and the tendering process as awhile.

The tenderers should, therefore, familiarise themselves with the applicable laws and the policies which are related to the requirements of the industry including the freedom of the information, the industry may exclude their tender from more considerations.

18 The Obligations Of The Industry.

Without the limitation of the industry obligations, the industry has the following rights

a. Refuse to continue with the tender process outlined above, including the right of not continuing with the project and refuse to enter into any contract.

b. Permit any tenderer to modify their tender

c. Call for fresh tenders

d. Allow or reject any tender that does not comply with the requirements

e. Waive or rate any rights of any tenderer under the industry act.

f. Discuss with any individual who is not a tenderer and even enter in to contract in relation to this tendering process terms and obligations

g. Publish the name of the successful tenderer and finally

h. Forward the name of the successful tenderer to the in charge industry with the relevant report of how the whole process has been.

19. Requirements For Quality Assurance And Quality Control

Compliance with the requirements.

The tenderer must participate in the whole process in accordance with the regulations

That this tender has complied with all the sections of the Australian act

Acceptance.

This tender encompasses a complete contract which relates to all the matters required for the purpose of completion of the project in delivering the industry requirements.

The tender remains open for the period not less than 20 days.
